Charnwood Industries Pty Ltd (ABN 87 690 793 358) is the single legal entity, and the data controller, behind every Charnwood product and service. This is Charnwood's own Privacy Notice, and it covers charnwood.io, its subdomains, and the Charnwood account. It covers everything those surfaces do, with any product-specific detail set out as a labelled sub-section within this Notice rather than as a separate policy. Any other website this company operates publishes its own privacy notice covering what that website collects, and this Notice does not describe it. More than one notice does not mean more than one company: there is one company and one ABN behind all of them, and a request you make to us under this notice reaches that company whichever website you sent it from.

How do we keep your information safe? We have adequate organisational and technical processes and procedures in place to protect your personal information. 1. What information do we collect?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

We do not collect payment card details. If we ever offer something you can pay for, payment is taken through a payment provider's own checkout, so your card details go to that provider and not to us.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings).

How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and from other third parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behaviour data), Internet Protocol (IP) addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.
Forms on this website
In Short: No page of the charnwood.io website collects personal information through a form. The forms that do exist under this domain are the ones for creating and running a Charnwood account, and they are set out immediately after this.
No page of the charnwood.io website itself collects personal information through a form. This website is the company's own page together with these legal pages: it carries no enquiry form, no booking form and no registration form. The only place on it that takes an instruction from you at all is the cookie preferences page, which records your cookie choice in a cookie on your own device and asks you for nothing about yourself.
The forms that do exist under this domain are the ones for creating and running a Charnwood account. They are on subdomains of charnwood.io, this notice covers them, and they are set out under 'Charnwood account forms' below. If we ever add a form to the website itself, it is described here in the same change that adds it.
Charnwood account forms
In Short: Creating and running a Charnwood account collects the details you enter into the sign-up, sign-in, and account settings forms. These are on subdomains of charnwood.io.
You can create and run a Charnwood account. These forms are not part of the charnwood.io website's own pages; they sit on subdomains of charnwood.io, and they are set out here because they are real forms that anyone can reach:
- Create an account (id.charnwood.io/sign-up). First name, last name, email address, a password, and, where you are signing up on behalf of an organisation, the organisation's name.
- Sign in, and reset a password (id.charnwood.io/sign-in). Your email address, your password, and the single-use codes we email you to confirm it is you.
- Account and organisation settings (on portal.charnwood.io, once you are signed in). Your name, your email address, and your display time zone. If you invite someone else into your organisation, the form also takes that person's email address.
How we handle these. We use account details to create and operate your account, to confirm that an email address is yours, to keep the account secure, and to send you service messages about it. Where you give us another person's email address in order to invite them into your organisation, we use it to send that invitation and to record the membership it creates, and for nothing else. Your email address and your name are recorded encrypted under a key we can destroy, so that destroying that key permanently prevents them being read, and your password is never stored in a form anyone can read. We rely on the performance of our agreement with you, and our legitimate interest in operating and securing the account, as the legal bases for this processing (see 'What legal bases do we rely on to process your personal information?' below). We do not use account details to build a marketing profile of you.
What our advertising and analytics tags receive
In Short: This website runs two tags, Google Analytics and the X (Twitter) website tag. Both record the pages you visit. Neither reads the fields of a form, and nothing you type is sent to an advertising platform from this website, in hashed form or in any other form. You can turn both off at any time on our cookie preferences page.
What runs here, and what it is for. Two tags run on the pages of charnwood.io. Google Analytics measures how visitors use the website and answers to the analytics cookie category. The X (Twitter) website tag measures the effectiveness of our advertising and answers to the advertising category. Both are listed, with what each is for, in our Cookie Notice: charnwood.io/cookie-policy. No other advertising or analytics tag runs on this website, and none runs at all on the account subdomains where the forms are.
What they receive. Each receives information about your visit: the pages you view and the technical information described under 'Information automatically collected' above. Neither reads the contents of a form, and we do not send your name, email address or mobile number to any advertising platform from this website, in any form, including in a hashed or encoded form. We state that in those terms because the opposite practice is common: some advertising tags read submitted form fields and send a hashed copy of them, and hashing in that setting is a matching mechanism rather than anonymisation. No tag on this website does it.
We receive no advertising click identifier on this website. A website that advertises on Google receives a click identifier on the link the advertisement is clicked from, may store it on the visitor's device, and may later report to Google that the click led to an outcome. We hold no Google advertising account for this website and run no Google advertisement pointing at it, so no click identifier is received here, none is stored on your device by us, and none is reported. If that ever changes, it is described here in the same change.
The accounts they report into. Visits here are measured in a Google Analytics property held for Charnwood, and that property is not linked to any advertising account, so what it measures is not used to build the audiences any advertisement is shown to. The X tag here reports into an X advertising account held for Charnwood.
Google and X are overseas recipients. Google and X are United States companies and each may also process information in other countries in which it operates, so information reaching either of them through these tags is a disclosure to an overseas recipient under Australian Privacy Principle 8. Each receives what it receives under its own terms for businesses and uses it for its own purposes as well as for ours, so neither is a service provider acting only on our instructions, and you should read their privacy policies as well as this one.
Whether either runs at all depends on your cookie choice, and where you are decides the starting point. If you are in the European Economic Area, the United Kingdom or Switzerland, or we cannot tell where you are, we ask you first and nothing optional runs until you accept it. Everywhere else, including Australia, these tags are treated as accepted unless and until you turn them off. You can turn them off at any time on our cookie preferences page, and once you have, they do not load. Under Australian privacy law we rely on this notice, on the purposes being ones we have told you about, and on your ability to turn the tags off; where the GDPR applies to you we rely on your consent, which is why nothing runs in those regions until you give it. A cookie cannot be shared between two separate domains, so the choice you make here applies to charnwood.io and its subdomains.
2. How do we process your information?

We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.

3. What legal bases do we rely on to process your personal information?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e. legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests.
We process your personal information under Australia's Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because we operate internationally, we may also rely on the following legal bases where the laws of other jurisdictions (such as the General Data Protection Regulation (GDPR) in the EU and the UK GDPR) apply to you:

- Performance of a Contract. We may process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
- Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. 4. When and with whom do we share your personal information?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ('third parties') who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organisation apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.
Google and X are the exception to the paragraph above, and we say so rather than leave it implied. Both receive information through their own tags in your browser, under their own terms for businesses, and each uses what it receives for its own purposes as well as for ours. They are not acting only on our instructions, and we are not in a position to promise on their behalf that they are.
The third parties we may share personal information with are as follows:
- Web and Mobile Analytics
- Google Analytics, which measures visits to this website in a Google Analytics property held for Charnwood, and which is not linked to any advertising account
- Advertising measurement
- X (formerly Twitter), which receives page-view information through its website tag where advertising cookies are running, and none of the details you enter into a form. It reports into an X advertising account held for Charnwood, and it is the only advertising tag on this website
- Website Hosting and File Storage
- Fly.io, which hosts this website. No form under this domain accepts a file upload, so nothing you send us is held in Fly.io's object storage service
- Email and Productivity
- Microsoft, whose Microsoft 365 service carries and stores the service messages we send you, including the single-use codes and the organisation invitations described under 'Charnwood account forms' above
Overseas recipients. The third parties named above are located outside Australia, principally in the United States: Google, X, Microsoft and Fly.io are all United States companies, and each may also process information in other countries in which it operates. Sharing personal information with any of them is a disclosure to an overseas recipient under Australian Privacy Principle 8. The contractual safeguards described at the start of this section apply to the providers that act on our instructions. They do not apply in the same way to Google and X, for the reason given above. None of the details you enter into a form is sent to an advertising platform from this website, which is set out under 'What our advertising and analytics tags receive' above.
We also may need to share your personal information in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honour this Privacy Notice. Affiliates means any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us. Charnwood Industries Pty Ltd has no parent company: it is the company at the top.
- Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
5. Do we use cookies and other tracking technologies?

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. 6. How long do we keep your information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section 'How can you contact us about this notice?' below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

10. Controls for do-not-track features
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

Australia and New Zealand
We collect and process your personal information under the obligations and conditions set by Australia's Privacy Act 1988 (Cth) and New Zealand's Privacy Act 2020 (together, the Privacy Acts).
This Privacy Notice satisfies the notice requirements defined in both Privacy Acts, in particular: what personal information we collect from you, from which sources, for which purposes, and other recipients of your personal information.
If you do not wish to provide the personal information necessary to fulfil their applicable purpose, it may affect our ability to provide our services, in particular:

- respond to or help with your requests

If you believe we are unlawfully processing your personal information, you have the right to submit a complaint about a breach of the Australian Privacy Principles to the Office of the Australian Information Commissioner and a breach of New Zealand's Privacy Principles to the Office of the New Zealand Privacy Commissioner.
